South Dakota legislation has passed numerous insurance laws.  Below is a summary of the law that applies to insurance licensing:

HB 1030:  Pertains to surplus lines insurance and tax allocations due to the NonAdmitted and Reinsurance Reform Act (NRRA) passed in 2010.  The bill

  1. Clarifies which state is the home state in multi-state transactions
  2. Specifies the home state is the only state where tax is collected unless there is a uniform reporting eligibility and tax allocation procedure entered into among the states
  3. Streamlines surplus lines  pertaining to multi-state transactions
