Effective January 1, 2011, the Pennsylvania Insurance Department will have an additional process in its Electronic Filing System (EFS) that will allow surplus lines licensees to file incomplete filings. There will also be an additional process for licensees to file the 1609-SLL form and include details pertaining to the writing producer who failed to submit the required Producer Affidavit. The filing will go to the Department.
In addition to the $25 stamping fee and the $25 late stamping fee (when applicable) there will also be a $50 non-refundable fee when the 1609-PR Producer Affidavit is missing. The producer is still required to submit the completed Producer Affidavit.
NOTE: Neither the additional late fee or the $50 fee for the missing 1609-PR may be passed on to the insured.
Reminder: The passing of Act 14 in September 2010 included substantial increases in penalty fees for surplus lines law violations.
